NOTE TO FOREIGNERS DEPARTING TURKISH BORDERS WITH VISA OVERSTAY VIOLATION AND WHO DO NOT PAY FINE BEFORE LEAVING, SHALL BE ISSUED A 5-YEAR BAN ON ENTRY. HOWEVER DEPARTING FOREIGNERS AFTER ENTERING IN COUNTRY OF CITIZENSHIP OR LEGAL STAY, MAY PAY FINE WITHIN 10 DAYS AT TURKISH EMBASSY ABROAD TO LIFT THE 5-YEAR ENTRY BAN.
- The Directorate General, when necessary and upon consultation with the relevant government departments and institutions, may impose an entry ban against foreigners whose entry into Turkey is objectionable for public order, public security or public health reasons.
- The Directorate General or governorates shall impose an entry ban for foreigners who are deported from Turkey.
- The entry ban to Turkey shall not exceed five years. However, in cases where there is a serious public order or public security threat, this period may be extended for a maximum of an additional ten years by the Directorate General.
- The entry ban to Turkey for foreigners whose visa or residence permit has expired and who has applied to the governorates to exit from Turkey before their situation is established by the competent authorities upon which a removal decision has been taken, shall not exceed one year.
- Among those who have been invited to leave Turkey pursuant to Article 56 of the Law No 6458, an entry ban might not be imposed for those who leave the country within the specified period of time.
- The Directorate General may revoke an entry ban or, allow the foreigner to enter into Turkey for a given period of time, without prejudice to the entry ban.
- For reasons of public order or public security, the Directorate General may introduce advance clearance conditions for the admission of certain foreigners’ to Turkey.
PROHIBITION OF ENTRY INTO TURKEY BY CUSTOMS IMMIGRATION OFFICE.
Infringement of visa violation, results a ban on Entry to Turkey is imposed in case of violation of the legal period of stay (Residence Permit, Work Permit, Visa Period or exceeding the Visa Exemption period) of Foreigners and International Protection Law, it is applied within the scope of article 9. In addition, the General Directorate of Migration may, if necessary, prohibit foreigners from entering the country who are outside Turkey but find it inconvenient in terms of public order, public safety or public health.
Despite the fact that they have exceeded the legally recognized period, a Ban on Entry to Turkey does not apply in cases where the following conditions occur:
Foreigners who want to exit the border crossings on their own accord and pay the administrative fine that has been issued to them, despite the fact that they have exceeded the recognized period of up to 3 months.
Foreigners who have committed violations for up to 3 months, days and have received a deportation decision on their rights and who have paid administrative fines by going to the border crossings to check out during this period.
More than 3 months and who have done their requests to leave the country with out leading to the border crossing to Turkey, and administrative fines ban entry to foreigners paying between 1 month and 5 years is applied. The periods of this prohibition are as follows:
– In case of overstay upto 1 month: monetary fine + ban of entry for 3 months.
– In case of overstay from 3 months: monetary fine + detained + deported at own cost.
– In case of overstay from 6 months to 1 year: monetary fine + detained + deported at own cost.
– In case of overstay period from 1 year to 2 years: monetary fine + detained + deported at own cost.
– In case of overstay period from 2 years: monetary fine + detained + deported at own cost.
– In case of overstay period from more than 3 years: monetary fine + detained + deported at own cost.
EVEN IF THE ESTABLISHED ENTRY BAN DECISION HAS EXPIRED, FOREIGNERS WHO DO NOT PAY FINES AND OTHER ADMINISTRATIVE RECEIVABLES ARISING FROM FEES LAW NO. 492 AND OTHER LEGISLATIVE PROVISIONS ARE NOT ALLOWED TO ENTER TURKEY IN ACCORDANCE WITH ARTICLES 7 AND 15 OF LAW NO. 6458, UNLESS THEY PAY THESE FINES AND RECEIVABLES.
